Care-home component qualification review

21 September 2026. Model-authored source review; not specialist acceptance, current legal advice or an entitlement decision. The original investigation was read-only. The implementation section records the subsequently authorised housing and temporary-care changes. The larger disability-addition options remain proposals. No frozen source, trial or review obligation changed.

This is the earlier component review. The separate disability-addition increment records the subsequently implemented overview and no-partner support groups, including the receipt qualifications and their remaining limits. The proposal and measurement below retain their original scope.

Result and proposed order

  1. Housing costs: correct two scope phrases before declaring dependencies. The source concerns housing-cost treatment during an absence, not permission to stay in a care home. It excludes Housing Benefit expenditure defined as an element for which Housing Benefit may be payable, rather than only expenditure actually met by Housing Benefit. Five already-modelled whole pages support a bounded summary.
  2. Temporary care-home residence: restore the explicit claimant with no partner qualification to the opening statement. Two already-modelled pages carry the operative paragraphs and complete example.
  3. No-partner disability addition: avoid equating every occurrence of “in receipt” with actual current payment. The captured chapter has deemed-receipt provisions on pages 16–17, which are acquired but not in the semantic base. An eight-page support group covers the current named material with its example continuation; a ten-page group is justified if the definition explicitly incorporates the receipt qualifications. The Scottish amendment dependencies remain separate and version-qualified.
  4. Severe-disability addition overview: prefer a short navigation/identity definition, with four supporting pages. Keeping its statement about Scottish amendments requires the actual memo support as well. Do not make every generic overview activate every detailed condition branch.

These are distinct from full answer closure. They do not resolve funding-specific disability-benefit cessation, legal versions, judgments, household facts or the other recorded obligations.

Exact replacements for the two immediate scope defects

These replacements were approved for the bounded implementation described below. They remain model-authored interpretations requiring specialist review.

Housing-cost definition, replace the final exclusion sentence:

Permanent residence and Housing Benefit expenditure are separate exclusions. DMG 78271 defines Housing Benefit expenditure as an element for which Housing Benefit may be payable; actual payment of Housing Benefit is not stated as a condition here.

Also replace its sentence beginning “DMG 78240 permits a trial stay” with:

DMG 78240 allows treatment as living in the former home, with housing costs allowed, for a trial period of up to 13 weeks, subject to assessment of suitability, intention to return if unsuitable and the normally occupied part of the home not being let or sublet. This temporary-absence treatment is subject to the stated overall maximum of 52 weeks.

Temporary-care-home definition, replace the opening sentence:

For a claimant with no partner whose normal home circumstances do not satisfy the additional-amount conditions, DMG 78084 says a temporary care-home stay does not itself change their normal residence.

This narrower sentence leaves the following 78085 partner branch and the 78086 DLA-payability conjunction intact. It does not assert that living with any other person automatically prevents the addition.

Reviewed identity and source boundary

The original review read the four definitions unchanged from the household trial source at DWP 3ef0e786e9a18e76fa17c7d925ff509d6d6c9f84, through the preceding qualification candidate. That reviewed semantic index SHA-256 is b713c2c165f8198f50a5500feadaf0ce1573a85fa88f2a0ae6c785298d925fb2. Literal definition digests below bind the actual wording independently of the new file-level authoring provenance.

Unless stated otherwise, page/78/NNNN means https://chris-page-gov.github.io/okf-dwp/id/page/78/NNNN, a one-based PDF page in Chapter 78. “Already modelled” means the record is in this semantic index, not that the current bounded Ask package necessarily selected it. “Acquired” means it exists in the frozen whole-page corpus.

DMG 78270 concerns the housing-cost additional amount, not the whole Pension Credit award. It states that an additional amount for housing costs is not allowed for claimants in a care home unless their absence from the dwelling normally occupied as home is temporary. The exception does not establish payment of care-home fees. DMG 78240 permits a trial stay of up to 13 weeks only with suitability assessment, intention to return if unsuitable and an unlet home; the overall absence limit is 52 weeks. DMG 78254–78257 set separate 52-week conditions including intention to return, no letting or subletting, a listed reason and expected duration. Permanent residence and expenditure met by Housing Benefit are separate exclusions. The complete paragraphs span adjacent pages.

Reviewed literal before this increment: temporary-care-home

DMG 78084 does not turn a claimant who normally lives with another person into someone normally living alone during a temporary care-home stay. DMG 78085 retains household membership for a temporarily absent partner, but DMG 78086 requires a review of Pension Credit and the severe-disability addition if residential care exceeds 28 days and DLA payability ceases. The example continues on the next page. These are component and qualifying-benefit conditions, not a universal 28-day end to Pension Credit.

The no-partner branch in DMG 78034 requires a specified qualifying disability benefit, no adult normally residing with the claimant unless ignored, and no Carer’s Allowance payment or Universal Credit carer element for caring for them. Read the protected and ignored-person exceptions in DMG 78035–78036 and 78077–78080. DMG 78055–78057 distinguish actual payment from underlying entitlement. The heading Claimants who have no partner (including self-funders) governs DMG 78088: all conditions must still be met. It says normally self-funders and also the first four weeks while AA, DLA or PIP continues; funding status alone cannot prove continued qualification. Scottish-benefit memoranda are separate dated dependencies. Partner cases use DMG 78045–78050.

The Pension Credit additional amount has different no-partner and partner branches, qualifying-benefit receipt, household and carer conditions. DMG 78088 concerns claimants who have no partner, including self-funders; it is not a rule for every care-home resident or the whole Pension Credit award. Dated Scottish-benefit memoranda amend dependencies. It is not the Severe Disablement Allowance benefit.

A. Housing-cost component

Smallest support for the bounded current subject

Require pages 78/53, 78/55, 78/56, 78/57 and 78/58 (five pages), after the wording corrections below. All already exist in the semantic index.

55–56 78254: the separate up-to-52-week branch. Intention to return, no letting/subletting, a listed reason, and expected duration all matter. Page 56 contains the care-home/independent-hospital reason 3.11, distinct from the trial branch, and the exceptional expected-duration qualification. Footnotes: Schedule II 4(11)–(12), including 4(11)(c)(ix).
56 78255: intention to return must be unqualified, present from the beginning and not depend on an event outside the claimant's control; an intention formed later is insufficient.
57 78256–78257: consecutive-absence treatment and when the absence becomes treated as permanent. Keep the expected-duration/exceptional-circumstances wording, rather than suggesting automatic entitlement for a year.
58 78270–78271: housing-cost additional-amount exclusion and temporary-absence route. HB expenditure means an element for which Housing Benefit may be payable. Footnotes: Schedule II 5(1)(a)/(b), Housing Benefit Regulations 12(1).

Narrow the definition: replace “permits a trial stay of up to 13 weeks” with “allows the former-home housing-cost treatment for a trial period of up to 13 weeks, subject to the stated conditions”. Replace “overall absence limit” with “maximum period treated as temporarily absent for this housing-cost purpose”. Replace “expenditure met by Housing Benefit” with “Housing Benefit expenditure, defined here as an element for which Housing Benefit may be payable”. This does not establish payment of care-home fees.

Optional page 78/54: it contains a complete worked example showing 43 prior hospital weeks leaving at most nine assessment weeks, followed by the separate general 13-week absence branch 78241–78243. It is useful for a worked example or a general temporary-absence question, but those rules are not needed to substantiate the narrower five-page summary. If explaining 78243, keep its continuation on page 55. Do not read the general 78241 rule as replacing the separately specified 78240 branch.

Not supplied by this support group: expenditure calculation, every excluded housing cost, Housing Benefit access/award rules and case-specific eligibility. The existing statutory-body overlay includes Schedule II paragraphs 4 and 5 and Housing Benefit Regulations 12; their existence does not reconcile dates, extent or case applicability. Definitions used in the many listed 78254 reasons are conditional routes, not mandatory evidence for every care-home question.

Activation: Staff 012 and 013 need this component if their interpretation asks whether any part of Pension Credit stops; Staff 018's “all scenarios” scope also makes the branch material. Do not activate it merely because the broad Pension Credit concept resolved. Keep a resolved care-home root and an explicit care-home → care-home-housing-costs → source path, rather than injecting the component as a new seed.

B. Temporary-care-home component

Require pages 78/24 and 78/25 (two pages), both already modelled. Page 24 supplies 78084–78086; page 25 completes the Malcolm/Wendy example, including the note that the lower-rate addition is not appropriate in that respite-care example. The example must not become a general four-week cessation rule.

Narrow the first sentence: “For a claimant with no partner whose normal home circumstances fail the additional-amount conditions, DMG 78084 says temporary admission does not itself change their normal residence.” This preserves the heading and avoids suggesting that every person who lives with somebody is disqualified; ignored-resident rules may be relevant.

Optional further evidence: page 78/17 (78065–78066) defines normal residence and includes respite-care examples. It is acquired but not in the semantic base. Use it if actually explaining normal residence. The ignored-person group, pages 78/21–78/23, is needed if the answer decides which other residents count. Do not silently infer those facts. Chapter 77 household qualifications are a separate declared dependency if explaining household status beyond the limited temporary branch.

Activation: the permanent-residence wording in Staff 012 and 013 does not justify making every temporary rule an unconditional profile requirement. If the overview retains a permanent/temporary contrast, the selected temporary summary must carry these two pages. A specific temporary/respite-care question should have its own explicit profile. Staff 018's stated permanent “all scenarios” question still needs the boundary explained, without converting it into an unrestricted temporary-care answer.

C. No-partner disability-addition component

Current named support versus necessary receipt qualification

The named paragraphs in the current definition are on 78/11, 78/12, 78/15, 78/21, 78/22, 78/23 and 78/25. Add 78/24 when retaining the shared-lives material on page 23, whose example continues there. This yields an eight-page whole-context support group for that particular wording, not a complete current-law condition set.

Pages Qualifications that must not be lost
11–12 78034 no-partner lower-rate conditions; 78035–78036 preserved Carer's Allowance payments under the stated transitional protection do not automatically disqualify the addition. Page 12 also begins the separate partner branch.
15 78055–78057: establish relevant benefit/carer payment; payment because of somebody else's disability is different; for CA/UC carer element, actual payment matters before it affects the addition. The source also routes hospital cases to 78805 onwards.
21–22 78077: ignored-person categories and their continuations/footnotes. Do not truncate after the disability/blindness categories; the paid voluntary-carer, partner and child/qualifying-young-person categories continue on page 22.
22–23 78078: additional ignored-person rules, commercial arrangements, close-relative qualifications and the first-twelve-weeks limit for the newly arriving carer branch. Page 23's further note distinguishes the right to occupy from the physical move-in date.
23–24 78079–78080: commercial liability, shared-lives conditions, the limiting note about other non-ignored residents and the example continuation. R(IS) 11/98 is a cited judgment, not supplied judgment-body evidence.
25 78087–78088: permanent residence and other residents; controlling no-partner/self-funder heading; all conditions continue to matter; normal self-funding and initial four-week continuation are conditional descriptions.

Important additional qualification: the present sentence “78055–78057 distinguish actual payment from underlying entitlement” is too easy to apply to every benefit. 78060, pages 78/16–78/17, includes deemed receipt for certain periods and a distinct rule about CA/UC before its first payment. The partner hospital rule is separate again. These pages are acquired in the full corpus but absent from the semantic index. They are not an acquisition gap.

Preferred next wording: specify that the actual-payment statement concerns the CA/UC carer element under 78057 and explicitly point to 78060's treated-as-receipt rules rather than implying a universal cash-in-payment test. If that receipt explanation stays in the definition, require 78/16 and 78/17 too: a ten-page chapter group. Do not claim that adding those pages completes every hospital or funding rule.

Conditional/optional routes: pages 78/13–78/14 complete partner lower/higher-rate branches 78046–78050, already modelled, but they should not become unconditional dependencies of a no-partner branch merely because the definition says partner cases use those paragraphs. A current detailed partner comparison needs the whole 78/12–78/14 group. Pages 78/18–78/20 concern normal-residence/sharing factual detail; they are acquired but not modelled. Use them when those facts are actually analysed. Definitions of “AA”, blindness and voluntary organisation are on 78/5–78/6, acquired but not modelled, and become relevant when explaining those terms rather than keeping a generic “specified qualifying benefit” phrase.

Dated memo dependencies: the captured 78034, 78035–78036, 78055–78060 and 78077 explicitly carry memo 02/25 pointers. Its page 5, paragraphs 13–16, supplies the Pension Age Disability Payment changes and source-stated date. Memo 06/25 page 9, paragraph 30, changes qualifying benefits for Scottish Adult Disability Living Allowance; its page 3 supplies the introduction/date. Memo 01/26 page 3, paragraph 5, supplies the Carer Support terminology change, while paragraph 6 uses different component wording. Keep those literal differences; this review does not reconcile them. All four memo pages are already modelled and acquired. If the summary retains the Scottish-dependencies statement, explicitly bind them or the appropriately narrowed source-backed memo concept; do not treat them as universal synonyms or a specialist-reviewed consolidation.

Legal/acquisition gaps: statutory bodies for regulation 6 and Schedule I paragraphs 1 and 2 are present. The inspected legal-body overlay does not supply Schedule I paragraph 3 (cited in the close-relative/shared-lives material), the R(IS) 11/98 judgment, or the complete funding/cessation rules for every AA/DLA/PIP/Scottish benefit. The guidance and memo pages themselves are acquired. Legislation and memo dates, territorial application, transitions and the private facts remain unresolved.

Activation: the conditional no-partner component belongs in Staff 012 and 013's review, alongside the household dependency needed to establish the branch. Staff 018 needs explicit partner alternatives as well; it must not inherit a no-partner-only sufficient result. Staff 014 and 017 can activate a bounded partner comparison, not the no-partner branch solely because partner resolved. Preserve all question-scope obligations and existing ambiguous benefit identities.

D. Severe-disability-addition overview

This is an overview/identity concept, not a consolidated rule. Its current core statements need 78/11, 78/12 and 78/25, plus page/dmg-vol10-ch57/0005 if it keeps the explicit distinction from the Severe Disablement Allowance benefit. The latter page's 57001 identifies the separate legacy benefit; no closure or present availability finding follows from using it for identity.

The overview's “Dated Scottish-benefit memoranda amend dependencies” statement needs actual amendment support. At minimum, the already-modelled 02/25 page 5, 06/25 page 9 and 01/26 page 3 substantiate the named amendment families; include 06/25 page 3 if asserting its commencement/introduction context. Keeping the full existing Scottish-dependencies concept would require all its asserted-date source pages, not merely its short authored text.

Smallest preferred wording: make this a navigation definition identifying the Pension Credit addition, the separate no-partner/partner branches and the limited 78088 heading, with a distinct legacy-benefit identity reference. Put detailed receipt, ignored-person and dated-amendment explanations in their own conditional source-backed components. That narrow overview can use the four-page core. If the existing amendment sentence stays, its memo sources are not optional.

Do not create mutual requires relationships between the overview and the legacy-SDA ambiguity concept; both descriptions mention the distinction and could create a cycle. Directly requiring the already-modelled Chapter 57 identity page, or using an independently bounded identity component, is clearer. SDA remains ambiguous where the user's intended meaning is not resolved.

Activation: use this overview when the Pension Credit severe-disability addition is resolved or a care-home question genuinely calls for the component. Its presence must not activate a different legacy benefit or every partner scenario. A broad overview profile cannot acquire completeness by fetching a short introduction.

Proposed implementation boundary

The bounded implementation below adopts only the housing and temporary-care recommendations. Further dependencies must not be added automatically from this review. Remaining work includes:

The housing and temporary-care increment is implemented below. The no-partner group still requires a deliberate decision about how much receipt/amendment detail the definition promises. None of these increments by itself answers Staff 012, 013 and 018 completely.

Implemented bounded increment

The concept authoring now contains the exact housing wording corrections and the no-partner qualification shown above. It declares:

The Staff 012 and Staff 013 profiles now name care-home-housing-costs alongside household-separation in qualification_concepts. Their original candidate requirements already included housing page 78/58, so the new declaration supplies its stated conditions and exceptions through existing directed paths. The five housing paths start at the resolved care-home concept, follow its existing skos:related link to housing costs, then the explicit dcterms:requires link to each source page.

Temporary-care dependencies remain record-level only. The permanent-residence profiles do not unconditionally require the temporary summary or page 78/24. If that summary is selected, the engine can inspect its explicitly declared two-page dependency. Page 78/25 is already relevant to the permanent branch and household definition. Housing page 78/54 remains an ordinary optional reference.

The existing producer compiles these declarations without a schema or predicate change. The prior eight household dependencies are preserved; the five housing and two temporary dependencies bring the total to 15. The new source index has 901 records and 1,442 assertions, with two qualification profiles and all 203 obligations still open. Each of Staff 012 and 013 has 20 required identifiers, including its five open obligations, and 17 required paths. Original question wording and candidate identifiers are unchanged.

Neither the no-partner-disability-addition nor the severe-disability-addition definition or dependency declaration changes in this increment. Their larger source groups, deemed-receipt pages, memo reconciliation and possible narrower overview remain explicit follow-up options in sections C and D. Funding-specific cessation, judgments and legal applicability are still unresolved.

The 31 producer controls pass, including the unchanged eight-edge household group, overall 15-edge census, exact five/two component support groups, resolved-root housing paths, optional page 78/54, absence of unconditional temporary-profile activation, the no-partner heading, the DLA-payability conjunction and the Housing Benefit “may be payable” distinction. Frozen source and original candidate/obligation preservation controls also pass.

Generated source snapshot: dwp-staff-semantics-fc2ad1545adcbeeb2243; semantic index SHA-256 7ffc9d00e71fef6aed5531373510df82998123e89fdb28091cfb82384adf2876. This identity differs from the preceding household-only candidate. Producer verification does not prove package retention or answer accuracy. The combined Reader integration now preserves all 15 support relationships and passes its 20 offline controls; the separate joint engine/source evaluation now passes all 320 assemblies and exact replay. Earlier trial and public observations retain their original identities.

Joint retention status

The final DWP source 7f9feb9634e3d94004853b838462aca132c505a5 and Explorer c4f2de0a99b7bc2f8b8c8a06a3c715fb56b66d8e retain all 433 activated declared path occurrences and all 177 known candidate occurrences at 256 KiB and 512 KiB. Staff 012 and 013 each retain all seven household support pages and all 17 paths in their own profiles. Their three activated profiles together declare 39 paths. The 256 KiB packages have 27 records and 63 relationships; the 512 KiB packages have 62 records and 124 relationships. The larger packages also expose the missing support temporary-care-home → page/78/0024 on optional context.

The separate 64 KiB Staff 012 observation correctly returns only a 1,926-byte metadata_budget refusal, rather than hiding a missing qualification. No model trial was rerun. All 203 obligations remain open; the larger no-partner and severe-disability overview sets described above remain unauthored proposals. Protected publication and new public checks are pending. The exact results, source-only controls and trade-offs are in the joint receipt guide.

Literal source hash appendix
